These terms govern your use of Placemarks (www.placemarks.co.uk), operated from the United Kingdom. By using our services, you agree to these terms.

1. Using Placemarks

Consumer accounts

  • You may browse the site without creating an account
  • To save places, create collections, or leave reviews, you must create a free account
  • You must provide accurate information and keep your account secure
  • You must be at least 16 years old to create an account

Business accounts

  • You may claim a business listing if you are authorised to represent that business
  • You are responsible for the accuracy of your business information
  • Fraudulent claims may result in removal and account suspension

2. Content & Reviews

  • You retain ownership of content you submit (reviews, photos, descriptions)
  • By posting content, you grant us a non-exclusive, worldwide licence to display it on the platform
  • Reviews must be genuine, based on real experiences, and not misleading
  • We may remove content that violates these terms, is abusive, defamatory, or fraudulent
  • Businesses may not post fake reviews or incentivise reviews in exchange for compensation

3. Paid Subscriptions

  • Business Pro (£9/month) and Business Featured (£29/month) are recurring subscriptions
  • Payments are processed securely by Stripe. We do not store card details
  • Subscriptions renew automatically each month until cancelled
  • You may cancel at any time. Access continues until the end of the billing period
  • Refunds are not provided for partial billing periods
  • We reserve the right to change pricing with 30 days' notice to existing subscribers

4. Free Trials

  • Pro and Featured plans may offer a 14-day free trial
  • You will not be charged during the trial period
  • If you do not cancel before the trial ends, your subscription will begin automatically

5. Acceptable Use

You may not:

  • Scrape, crawl, or bulk-download content from the site
  • Use the platform for spam, phishing, or malicious purposes
  • Attempt to gain unauthorised access to accounts or systems
  • Impersonate another person or business
  • Use automated tools to submit content or interact with the site
  • Circumvent rate limits, security measures, or access controls

6. Intellectual Property

  • The Placemarks name, logo, design, and code are our intellectual property
  • User-submitted content remains the property of the submitter
  • Business listing data submitted by business owners remains their property

7. Limitation of Liability

  • Placemarks is provided "as is" without warranty of any kind
  • We are not responsible for the accuracy of user-submitted content or business listings
  • We are not liable for any loss or damage arising from your use of the platform
  • Our total liability is limited to the amount you have paid us in the 12 months preceding the claim

8. Termination

  • You may delete your account at any time via your dashboard settings
  • We may suspend or terminate accounts that violate these terms
  • On termination, your personal data will be handled as described in our Privacy Policy

9. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the site. Continued use after changes constitutes acceptance.

10. Governing Law

These terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
